Shelton Publishing & the TotallyDecatur Strike Again

Some who blog here are like many in the area—we no longer have an extant high school alma mater. It’s a good guess that many are like us and no longer take any special interest in high school football. We hope those who graduated from Coffee and Bradshaw do wish Florence High School well.

If you haven’t kept up at all, FHS hasn’t had a great year on the gridiron. So while glancing at the TD website, we clicked on the article about Friday’s game, a game Florence lost to Austin. We didn’t particularly want to read the gory details of Florence’s loss; we simply wanted to know how many games FHS had won this season, assuming this statistic would be mentioned in the article.

So we read; first there was a quote from the Austin coach. Okay, Austin won; nothing too odd about that. Then the article went on to extol the virtues of Austin, never mentioning Florence in any specific way. Then we looked at the byline. Of course…it was an article written specifically for the Decatur Daily, Austin being a Decatur school.

Austin is a large school. Does it play Muscle Shoals? It might even play Deshler or Sheffield under certain circumstances. Certainly other Decatur area schools play local teams. Is it too much to ask the Shelton Publishing Company to have their sports correspondents write a neutral article when it’s scheduled to appear in the Shoals as well?

Wait…that was a silly question, wasn’t it?

First a word to single women: Let’s emphasize one more time…no, the prisoner/bad boy/druggie you’re dating isn’t any different than the others. Want to wind up in a ditch? Go ahead and date him. Want to live a long life? Find a nice guy or simply live alone. It won’t kill you…and that’s the point.

Vote tomorrow! Yes, if you live in an incorporated area, chances are there’s an election in your town tomorrow. If you don’t vote, you can’t complain, can you?

If you live in Florence, we can’t stress how important it is for you to vote for Steve Holt and Kaytrina P. Simmons. Unless, of course, you want four more years of being used and lied to.

Congrats Steve, Kaytrina, & ...Whoever!

It certainly looks like a recount or two for District Four in Florence. Six votes is an extremely close margin.

Congratulations to Steve Holt and Kaytrina P. Simmons on their victories! Now someone has a word for Dave Smith...

Whether you agree or disagree with an increase in lodging tax, the matter has not been handled well so far. Above is a report contrasting various states and cities.

Recounts?/A New Day

$
0
0

In very small towns, you expect to see only a few votes separating candidates in municipal elections; you may even see that particular phenomenon in towns the size of Sheffield and Tuscumbia, but in Florence?

Yesterday's elections produced contests in Tuscumbia where the office was ostensibly decided by three/four votes. One of the two council seats up for grabs in Florence was decided by only six votes. As of yet, no recounts have been announced. If there is an error, it's usually in the hand counting of absentee votes...no matter what Hermon Graham recently said.

However, Alabama law requires an automatic recount in general elections where the outcome is initially decided by .5% or less of the total vote. The latter would include the two Tuscumbia and one Florence offices up for grabs. The former? We've been asked what is a "general election." First, it's not a primary. Second, some sources define it as a statewide ballot.

Our apologies that we're not savvy enough to say if the law requires recounts in these three elections or not. Our guess would be even if it does, the outcomes will not change.

Yet even if there are no automatic recounts, a defeated candidate may petition for a recount. We await...

*****

While it looks like the same ol' same ol' in Sheffield and Muscle Shoals, the towns of Tuscumbia and Florence have a chance to enter a new era. This is especially true of Florence where a new mayor and four new council members will take their seats in November.

Only Dick Jordan and Andy Betterton will be returning. We look forward to Betterton's reaction when he must choose between Jordan's position and the position of a new, thinking council member.

*****

*****

As it stands now, there will definitely be at least one woman on the new Florence council. There will probably be two. If the latter comes to pass, it will be a first for Florence.

Now, the salient question: Was Susan Goode the odd person out in the mayoral primary due to her sex? We've heard some extremely interesting takes on that particular primary, and the war of the sexes was one factor mentioned. The others? That's a topic for another blog, but we'll get there.

A Reader's Take on Mickey

$

A reader's take... If Mickey Haddock thinks animals can't talk, he is mistaken. They spoke loudly Tuesday night. Also speaking loudly were tourism people and those that supported the Florence staff during the good ole boy shake down of Alison Stanfield and Debbie Wilson. Voting in droves were the senior citizens that were promised a Center as well.

Guess Mickey didn't execute the right plays so he fumbled due to his foul play. And he got caught for personal fouls too. Wonder what Mayor Dickey will do without his puppet? Too soon to tell but hoping the GOB system is over. Maybe Mickey can go to work for David Muhlandork..oh wait, he doesn't have a company any more.

Several have asked if Prince, our Canine-American blogger, will now be retiring. We're happy to announce he plans to stay at least until the new Florence shelter is completed.

Now let's return to the Florence Tourism website. A few days ago, we asked what's wrong with it. While we're sure many readers assumed it was the large mug shot of Rob Carnegie, we weren't referring to that.

Look at the history of Florence page. How many times is "Florence" mentioned? We count three. How many times is "Shoals" mentioned? We count three. Just who is paying Robbie Baby's salary anyway?

Oh, and we're still waiting for them to correct the most glaring grammatical error...

No More Demons for Florence?

It seems the Facebook page of Eddie Eugene Collins had no restrictions; in other words, anyone could post on it and many did. There were family members who either pleaded for Collins to surrender for the sake of his wife and children or commented he had made bad decisions so there was nothing to be done.

Then there was the local DJ who wanted an on-air interview during mid siege. Yeah…real classy KISS 106. What was he going to ask? "How does it feel to put a gun to your wife’s head?”

Yet the most commented on comment was from a woman who chastised Collins for bringing his “demons” to Florence. True, each city has enough local demons without all those Florida ones popping in for a visit. How did Collins even arrive in Florence/Killen? By all accounts, he was a user, not a dealer. At least where drugs were concerned; he had a July 2015 arrest for pimping out his wife. How does someone fall that far?

This makes two women in one week who are now dead due to the actions of the men in their lives. There is a lesson here, ladies. Yes, it can be you if you allow it to happen.

*****

So Jeb Bush is joining the Jay Z tour? Yes, he doesn’t like it if you call women bad names since he has granddaughters. Uh, Jeb, what about your mother, wife, and daughter? Was it okay to call them a “witch” or other derogatory names? Your friend Jay Z wised up when he had a daughter, so he’s ahead of you there.

Conclusions? Will Queen Elizabeth take the colonies back?

They Know Where You're Sleeping/Still Missing

Several readers have asked how local law enforcement knew where to find Eddie Collins and his wife. We have no inside information as to how it was determined where Collins was, but we do know one has to present a picture ID when checking into a hotel/motel. If the couple had been there for weeks, not on any obvious business, there’s a good chance a clerk became suspicious and asked Killen police to check them out.

We’ve also heard several people comment how unusual a case it was. No, not really. Take a look at the most wanted in your home county. How many are wanted for serious crimes? How many are removed from the list in a short...or long…period of time? Just as this Florida fugitive sought to hide in the Shoals, you can safely bet several Shoals fugitives are hiding around the country as you read this.

Back in the late 1800s a local elementary school class visited the offices of what was then the Florence Times. The class was told reading the newspaper was the best way to add to one’s vocabulary. Does that apply today?

We’re not sure it applied even then, but it certainly doesn’t now. Someone needs to tell Tom Smith what “mitigating” means. No, mitigating circumstances don’t make a situation worse.

Anyone out there really want to improve your vocabulary? Pick up a cheap used copy of a SAT tutorial; it contains more words than you can shake a long, wooden object at.

Missing from the Shoals? As of now we have three missing persons in the past four weeks: Robert DeShawn Childers, Chance Southern, and Savannah Clever. There’s also Jansen Brewer from Lawrenceburg. Two are teens and will probably pop up at some point. Two are adults and are possibly endangered.

Yes, every area has its demons.

Hotel Management Turns Against Tourism Board

$
0
0

Let's say you own a small business. You’re trying to make every dollar count, but sometimes business travel is essential. You need to stay in the Shoals for five days; do you stay in Florence where you’ll pay $116.00 for a basic one hundred dollar room, or $111.00 for the same room across the river? In other words, would you stay in Sheffield or Muscle Shoals if it saved you $25.00?

Or how about this: Money is no concern, but you’re no fool either; where do you stay? Most visitors, especially if they’re here to play golf in the first place, will easily choose Colbert County.

Ahh, but there will also be those tennis tournaments. Maybe there will be and maybe there won’t be. Has Robbie Baby offered up any names for these organizations that wish to play on new courts in Florence…new outdoor courts?

Don’t count on locals to play, unless you close the existing courts, and maybe not even then. Why are the existing courts so underutilized? Most true tennis aficionados either have some sort of club membership or have forked out the blunt to build their own back yard courts.

Speaking of new tennis courts, just when did these proposed jewels morph from indoor courts to regular run of the mill outdoor lawn tennis set ups? Mayor elect Steve Holt was totally correct when he stated things were moving at an Eddie Frost pace.

Some quotes from local hotel management/civic leaders:

"If the tourism board and (current) City Council tries to force this thing, it means they aren't listening to the public, plain and simple." Steve Holt

"We want them to listen to us, but they never really have, and the tourism board has certainly never cared about hospitality employees' opinions. I still have to question why this happened without our knowledge and why." Vickie Atwood Romine

*****

Is there a bottom line? Perhaps it’s that of the five percent increase, the tourism board gets two percent. Can’t you just hear Robbie Baby singing, “Yea, Yea!”

But if Florence becomes the loser in the scenario? Will Robbie Baby then sing, “We never saw it coming.”

Domestic Violence on the UNA Campus?/Kudos to Campus Police

$

How common is domestic violence at the University of North Alabama? While it’s not an everyday occurrence, it’s certainly not rare. This was posted earlier today on the Shoals Insider:

While details are scant, the perp was reportedly armed and drove from Colbert County with a specific purpose in mind. Whether it was to talk to his estranged other half or something more sinister has yet to be reported.

PNS followed up with this article:

It’s only been a few weeks since this incident took place on the UNA campus:

Again, UNA police came to the rescue—something local citizens should be extremely grateful for. Until authorities become mind readers, efficient police work is the best answer to the violence these abusers bring to the campus and community.

*****

*****

Ryan Kent Pollard, termed a serial abuser by local media, is in jail again; this time without bail. It seems some have speculated his most recent arrest involves his latest girlfriend, a resident of Russellville. This may be true since we’re told she’s abandoned Facebook, at least for the time being.

However, what did she expect? We want to make it clear just being dumb and/or desperate is not an invitation to violence, but it’s certainly not a shield either. A reader has told us, in the for what it’s worth department, the couple was into BDSM and that Pollard’s arrest involves drugs, not abuse. Whatever the case, society is always the winner when abusers are taken off the streets.

Any other young ladies want to date a four time abuser? Or would that now be five time abuser? Whichever, we’re pretty sure he’ll be on the market when he gets out.

Lauderdale County Budget?/Lodging Tax

$

From a reader:

WHAT IS THE LAUDERDALE COUNTY COMMISSION THINKING?????

The following statments were taken from the September 27, 2016 and October 2, 2016 TimesDaily about the county's 2017 budget:

In an effort to increase starting salaries in all county departments, the Lauderdale County Commission on Monday approved an operating budget that included a $2,000 raise for all county employees.

We were in good enough financial shape that we could address some other needs,” Commissioner Roger Garner said following the meeting. “Every department had wants and needs, and we were able to address some of those.” so included in the budget was a 4 percent increase of employee health care benefits that totaled approximately $67,838.

“This is something that we have been talking about for two years. Thankfully, we were able to do it this year,” said Lauderdale County Commissioner Roger Garner.

Commission Chairman Dewey Mitchell, who is retiring at the end of October, said this is the biggest budget in the history of the county, and he warned commissioners to stop pulling from reserves before there would be no reserves left.

“We had to take two and three-quarters million dollars out of the reserves to balance this budget,” Mitchell said. “The county is very fortunate to have the reserves to balance the budget. It has not always been that way.”

The overall budget is $31,548,935, an increase of $2.1 million from the 2016 operating budget.

We just can’t keep depleting the reserves,” Mitchell said. “I hope in the future, the budgets will be balanced on incomes and not on reserves.”

It is stated above the Commission had to take two and three-quarters million dollars out of the reserves to balance this budget but the budget only increased $2.1 million from the 2016 budget. If I read that right the Commission had overspent their 2016 budget.

Did the Commission take into consideration the other things associated with that much of a salary increase. Taxes and retirement funds will increase plus the added expense of insurance. If they can’t balance a budget without getting funds from reserve there will be no reserves, then what will the Lauderdale County Commission do?

What will happen when Dewey Mitchell leaves office? He seems to be the only one that is worried about Lauderdale County?

What do you think?

The Presidential Debate, Inmates & Muskrats
By: The Midnight Rider
The Presidential Debate
We watched the 2nd Presidential Debate last night and it was something else. This year is the only time that we have watched a Presidential Debate. While we are not going to endorse a candidate at the moment, we have to say that the Debate last night was interesting. We would have to define it as semi-disorderly. We were very disappointed in the moderators. We expected more out of Anderson Cooper.
But here is a thought. The Debate was almost like WWE Monday Night Raw. So let’s get Jerry “The King” Lawler and Jim Ross to moderate the next one. That will definitely make it interesting.

Inmates picking up trash in Colbert County
There was an article in this morning’s Times Daily about the Colbert County, Alabama Sheriff’s Department using inmates to pick up trash along the highways and streets. We think this is a great idea. We are sure that paid labor raises that budget of the Colbert County Commission each year. This will help reduce that cost.
The article further stated that non-violent and short time inmates will be used. Whatever the inmate’s crime is, getting some fresh air has to be a relief from a jail cell. Of course, an armed Sheriff’s Deputy will be supervising them.
Good idea Sheriff Frank Williamson.

Earlier today we linked a Shoals Insider article on the passing of Jimmy "BeBop" Evans, a Shoals drummer. The article stated that Evans was an original member of the Muscle Shoals Rhythm Section.

Soon after we were contacted by our favorite consultant who informed us this was in error. Evans was a member of Jimmy Johnson's first band formed when both men were at Sheffield High School. Mr. Roger Hawkins, considered by some the finest percussionist of his day, was the original drummer with the Muscle Shoals Rhythm Section.

Whitfield Case Postponed/Theft Indictment Delayed

If you're not familiar with the Colbert County manslaughter indictment against the Whitfields, you may catch up here:

The case was originally scheduled for October 4th, but autopsy results have been delayed. There is some speculation this case may now be placed on a back burner and eventually disappear. We'll post any new dates/info as we receive it.

*****

*****

A reader has asked us how many times a district attorney may present a case in order to obtain a grand jury indictment. We're throwing that question out to our legal eagle friends; we can say the most we are aware of is three, but that does not mean there is a limit.

That brings us to the theft case against some members of a local volunteer fire department. Apparently the district attorney's office was unable to secure an indictment the first time it was presented. A reader has asked if it will be presented again.

Again we're awaiting some inside information. We can say that some insurance companies will demand prosecution even if the money is repaid.

*****

What's a common type of case that doesn't always bring an automatic indictment? Various types of sexual assault, especially those involving an adult victim.

And we wonder why Donald Trump and Bill Clinton always get off so easy?

You’re a female sitting next to a famous man on a first class air flight when he begins to kiss and fondle you. Do you:

A. Sit there and do nothing…for over 35 years?

B. Simultaneously hit him with whatever you have at your disposal and call a flight attendant?

C. Sell the story to a tabloid?

D. Both B & C?

If there is any doubt, the answer is “D.”

*****

*****

While we can’t speak for all who blog here, we don’t support Trump…or Hillary. Let’s face it, our country is in dire straits, and Canada, snow and all, is looking good to us.

However, Trump for all his faults is not the Anti-Christ. Nor is Hillary. They both have enough faults to debate without making any up.

Repeal the 19th Amendment? It’s become something of a satirical hash tag on Twitter, but still only satire for most. We’ve read of a few who said they would give up their vote forever if they could be sure Trump would win.

We also read of those who say they can turn lead into gold and water into gasoline. These people are not exactly hitting on all cylinders.

*****

The TD has just published several articles on the high number of children killed by firearms, especially in the South. If local district attorneys want to charge anyone in these deaths, shouldn’t it be the parents/guardians who leave these weapons unattended—or more importantly, their children unattended?

Who Bails These People Out?/New DV Law?

$

Jails are crowded; we understand that. What we can’t understand is how some criminals make bail over and over. No, we’re not even talking about the small time burglar who regularly gets arrested once a month until a judge grows weary of him and sends him South. We’re speaking of those who can easily be classified as dangerous.

We see that Skyler Burgess has been arrested in Colbert County for failing to appear at a court date. If you’re not familiar with Burgess, she makes Lindsey Lohan look like Pollyanna.

Does this woman, with four children the state supports, have the money for bail? We understand she’s entitled to an attorney even if her guilt is a given, but bail? Why call her “Armed and Dangerous,” then allow her out in the general public?

Is there a flip side? She’s probably so psycho that no jail wants the responsibility. We can understand that also. If she harms another inmate, who will be sued? The answer is the state, aka the taxpayers.

Obviously there are no easy answers. Yet we’re betting the public feels safer with her locked away.

*****

*****

We’ve always taken the position that the state too easily enacts new laws for every occasion. We still feel that way, but have a suggestion for a law we feel is needed in this state.

For many years, a certain number of misdemeanor DUIs qualify one for a felony. How about a similar law for Domestic Violence arrests? Sure, first degree Domestic Violence is now a felony in Alabama, but we see those like Ryan Kent Pollard who go to jail over and over for days at a time, but like Skyler Burgess, seem to return to freedom to offend again—read: beat up some other innocent female.

We welcome input and ideas on how best to have this law enacted.

Say Yes to Amendment Four!

In three weeks we’ll be voting for more than our next (gasp) president. We’ll be voting on 14 new amendments to our ridiculously long state constitution. We won’t try to make a recommendation on all of them, but Number 4 is a winner.

Proposed amendment four allows for more home rule for our counties. In other words, our county commissioners will be allowed more freedom on making laws that apply to our individual counties. They will also have less ability to blame others when things go wrong. This is a good thing. It’s always more efficient to curse someone in our own county than having to e-mail Montgomery.

*****

*****

Kindness or tolerance? We were speaking with our favorite advisor earlier today; he claims he’s not that kind, but merely tolerant. Both are good qualities that so many of us lack. Yes, you may inject our name here.

We do have to ask where tolerance should end? Is our judicial system too lenient? Perhaps it’s too hard? We think the answer depends mainly on the perp’s attorney…a good one could get Jack the Ripper off, while an ineffective one couldn’t save Mother Teresa.

Soon Lauderdale County will undergo judicial changes. It should be interesting…

An Interesting Lawsuit/Gale Satchell

From Austin Burdick:

Bessemer, Alabama- October 18, 2016- A hearing has been set for October 26, 2016 at 3:00 PM in the Birmingham Federal District Court in the case of Burdick vs. Kennedy et al.

Bessemer attorney, Austin Burdick, filed a lawsuit against five US Supreme Court Justices after their ruling in OBERGEFELL v. Hodges, which legalized same sex marriage. The lawsuit does not the issue of gay marriage; rather, it asserts that the defendants, JUSTICE ANTHONY M. KENNEDY, JUSTICE STEPHEN G. BREYER, JUSTICE RUTH BADER GINSBURG, JUSTICE SONIA SOTOMAYOR, and JUSTICE ELENA KAGAN abandoned the Constitution and violated their oath of office.

Burdick states in his lawsuit that the US Supreme Court’s opinion includes language that departs from all prior precedent and rewrites the 14th Amendment of the US Constitution while redefing the terms “freedom” and “liberty”. An amendment that has always acted as a limitation on government action is now said to be the basis for granting the government power to interfere in fundamental rights at a most intimate and personal level. This ruling sets aside nearly 150 years of protection and opens a Pandora’s box for court’s to expand government infringement into the lives and liberties of individuals in a multitude of other cases..Burdick hopes, that through his lawsuit, he can convince the Federal Court to issue a ruling that will uphold the US Constitution and limit government overreach.

The Federal Court in Birmingham, Alabama will hear oral arguments at the October 26, 2016 at 3:00 to determine whether or not to dismiss the case.

Austin Burdick is a private attorney whose office is located in Bessemer Alabama. The practice specializes in general law with a primary focus on the protection of basic constitutional rights of United States citizens previously protected by the 14thAmendment.

Halloween is fast approaching. Here are some aspects to remember on the upcoming date. Halloween can be fun for kids and adults alike. Don’t do anything stupid. If you do something stupid and go to jail, is that how you want to remembered when someone posts it on Facebook? You know they will. Be safe

Clowns
The Rider has already told you in a previous article that this Clown stuff is getting out of hand. The latest thing going around on Facebook is that the “Clowns are going to do a Purge on Halloween.” Yeah, ok. You going to be purging in some good ole boy’s yard and he is going to purge your ass with a shotgun.

Please, enough with the clown stuff.

Now, we are getting to the part of the Holidays that the Rider likes. Christmas. I just read that the City of Sheffield is holding their Christmas Parade December 1, 2016. What? That’s not a Christmas Parade. That is a Thanksgiving Parade. The Christmas Parade should be closer to, well, Christmas. I don’t understand this decision.

Did the DA Lie?/Still Missing

$

Yes, this is a strange case, and we would love to have our readers' input:

First, we usually read the Athens News Courier; you might be surprised at how many from Rogersville are regularly arrested in the fair city of Athens. Recently we read an interesting article about a volunteer firefighter who was on the sex offender registry. It seems he participated in fighting two fires which were close to schools and thus committed a crime. Regular readers know how we feel about those who abuse women and children, especially sexually, but in the case of a fire, wouldn’t we all be happy with any assistance we could get?

Now it gets interesting. We read an article about the firefighter in PNS, and it seems his crime was Second Degree Rape committed with a 15 year old girl when he was 23. The moral here is not to have sex with someone you don’t know well. Yet this man, now 54, stupid as he may have been at the age of 23, is not an ogre. Hadn’t the article in the News Courier depicted him otherwise?

We checked back and found that the Limestone District Attorney’s office had informed the reporter that the man had committed First Degree Rape, attacking a 17 year old girl. Which tale was correct?

We then checked the ALEA records and found that the man was indeed charged with and convicted of only Second Degree Rape. So why did the Limestone district attorney present the story as something more sinister? Somehow the sad case of Joel Moyers comes to mind…

*****

*****

There are still three people from Lauderdale County unaccounted for in the past month, two of them teenagers. The third is 51 year-old Robert DeShawn Childers. After four weeks, we may assume it reasonable to discard “just wanting to spend some time alone” as one possible reason for his leaving his home in northern Lauderdale County.

Unfortunately, foul play now seems the most likely reason for his going missing. If you know anything at all, no matter how small, please call the Lauderdale County Sheriff’s Department. Shawn may never return to his family, but we can still make sure he receives justice.
